A judge decided not to sentence Spencer Scarber Tuesday, even though he believes he was voluntarily absent from court.UPDATE 12/31/12 – The CHP placed Kyle Scarber, father of Spencer, on paid leave two days after sheriff’s investigators served a search warrant at his house, and one day after the CHP commissioner met with Sheriff Margaret Mims. Action News learned Kyle Scarber got clearance to make a trip to Mexico — the presumed location of his fugitive son.
UPDATE: Even though Scarber went missing during his trial, the trial went on with out him and the jury convicting the 20-year-old from Squaw Valley on two counts of rape and on robbery and burglary charges.
State prosecutor Leanne Le Mon told during the hearing what authorities know about Scarber’s disappearance. Based on federal border crossing records, they know that his mother, Gail’s car was recorded crossing the U.S. border into Mexico at 3:24 a.m. Wednesday. He did not cross back into the U.S., BUT his mother and sister walked back into the U.S. at the San Ysidro crossing at 4:44 a.m. Wednesday using their passports.
Le Mon said authorities believe Scarber traveled into Mexico with his mother and sister and is still there.
Judging by this, it looks as though his mother helped her son disobey the law. I would not be surprised if she is also financially supporting him while he is in Mexico. I hope that she is charged for what she did.

Spencer Scarber, 20, has been missing from Squaw Valley, Calif., since Wednesday, and the Fresno County sheriff’s office is asking for the public’s help in locating him.
Spencer’s dad, Kyle Scarber an assistant chief in the California Highway Patrol’s Central Division said he saw him at home on George Smith Road around 1:30 a.m. When he checked on him at 5:30 a.m. he didn’t find him, but he did find some blood on the drive way and a set of crutches his son had been using.
Checking for more information, I found this article posted by Valley News which states that Fresno County Sheriff Margaret Mims announced that Spencer Alec Scarber was arrested on several charges in connection with a rape that occurred at the 3200 block of Antelope Lane, in July 2011.
Scarber is 5’9″ tall and weighs 155 pounds. He has short brown hair and hazel eyes. Anyone with information is asked to call the Fresno County Sheriff’s Office at (559) 488-3111.
